LISTEN: Audio of the Supreme Court's oral arguments on gay marriage
The Supreme Court on Tuesday released an audio recording and transcript of the oral arguments in the case over Proposition 8, California's constitutional ban on same sex marriage.
It's the first of two landmark cases regarding marriage equality before the court. On Wednesday, the justices will hear a second case challenging the 1996 Defense of Marriage Act, the federal law that defines marriage as being between one man and one woman.
California voters passed Prop 8 in 2008, shortly after a California Supreme Court ruling legalized same sex marriage in the state. It has since been declared unconstitutional by three lower courts, though it is far from clear how the Supreme Court will rule.
Legal analysts say it was difficult to tell from the judges' questions where they might side on the issue. Theodore B. Olson, one of the lawyers arguing against Prop 8, told reporters after the arguments that he had "no idea" how the justices would rule.
