Durst was caught during a break in filming when he went to use the bathroom and did not take off the microphone he was wearing, The New York Times reports. The eccentric 71-year-old scion of a New York real estate empire has found himself drawing suspicion from authorities across the country: More than 30 years ago, Durst's first wife vanished during a weekend in Westchester County, New York, and in 2013, he was acquitted of shooting and dismembering his neighbor in Galveston, Texas, while posing as a mute woman. His friend, Susan Berman, was killed execution-style in Los Angeles in 2000, and he has maintained his innocence in that case, as well as in the disappearance of his wife.
It's unclear if the recording of Durst can be used in court, as it was made when he was alone and expected privacy, the Times reports, but Prof. Daniel C. Richman of Columbia University Law School said it could be admitted "so long as it can be shown that the tape wasn't tampered with." Catherine Garcia
